Subject:            Procedures For Filling Positions Under Rule 8.2.1

According to provisions of Civil Service Rule 8.2.1, no position at or above the pay ranges of AS-620, SS-419, PS-115, WS-218, or TS-315 may be filled on a permanent basis from the date of the gubernatorial primary election (October 20, 2007) through Inauguration Day (January 14, 2008), without obtaining specific approval from the Director.  The only other exception is for a position in a job title that has already been designated as a Shortage job under Rule 7.20(d).

 

The only methods by which vacancies in these jobs may be filled without prior approval of the Director are by Restricted Appointment, Job Appointment, and Detail-to-Special Duty.

 

To further clarify, unless the Director grants permission, vacancies covered under this rule that are filled by the following methods cannot be filled on a permanent basis through a probationary or permanent appointment into a regular, ongoing position.  This also applies to promotions and transfers into an agency while on permanent status. 

 

  • Jobs requiring an agency to submit an SF-2 (request to fill a vacancy) to Civil Service and that result in the issuance of a certificate (list of eligibles) must be accompanied by a letter of justification explaining why the vacancy needs to be filled.  The Director will then determine whether or not to approve announcing the vacancy and/or issuing a certificate. 
  • Agencies with promotional contracts and direct hire agreements should not announce jobs covered by this rule without obtaining prior approval of the Director by means of a letter requesting permission to fill.
  • Agencies should not announce QUEST or other jobs covered by any other delegated hiring procedure that would be covered by this rule without obtaining prior approval of the Director by means of a letter requesting permission to fill.

 

It should be noted that only shortage jobs are exempt from this rule.  Noncompetitive {Rule 7.20(a) and Rule 7.20(e)} jobs are not exempt.
